Big C Petitioned for Investigation on Tesco’s Unfair Trade Practices and Interfering with the Business of Others

Big C Supercenter PCL and Cencar Company Limited filed a petition to the Ministry of Commerce’s Trade Competition Commission to investigate Ek-Chai Distribution System Company Limited, operator of Tesco Lotus, on its breach of the Trade Competition Act B.E. 2542 (1999), which is considered in violation of the rights of Big C and Cencar by launching advertisement and marketing campaign which invited Carrefour’s customers to use Carrefour coupons at Tesco Lotus. The case is now under consideration of the Trade Competition Commission.

During 15-24 July 2011, Ek-Chai Distribution System Company Limited has openly advertised and invited consumers which hold Carrefour I-Wish membership card to send SMS to Tesco and receive gift voucher. The advertising brochures on this campaign had been intentionally distributed to customers near a number of Big C’s stores, which has caused serious damage to Big C as the sole acquirer of Cencar Company Limited, the former operator of Carrefour super stores in Thailand.

To protect the rights of Big C, Big C is forced to submit another petition to the Trade Competition Commission. The Company is also considering filing a lawsuit to the Civil Court to seek justice on Tesco’s unfair trade practices and interference with business of others to the fullest extent permissible by the laws.
